作者｜之间博客 在美国的亲属移民体系中，“等待”几乎是所有家庭的共同命运。有的父母提交了申请，却要等上几年甚至十几年，才能真正与家人团聚。而对于有未成年子女的申请人来说，这个等待还伴随着另一层焦虑——孩子会不会在等待中年满 21 岁，从而失去与父母一同获得绿卡的资格？这就是移民法里常说的 aging out，中文通常叫“过龄”。 为了避免因为政府审批延迟而让孩子“过龄”，美国国会在 2002 年通过了《儿童身份保护法》（Child Status Protection Act，简称 CSPA）。它的设计初衷，是在一定条件下“冻结”或“回溯”孩子的年龄，让他们在法律上依然算作“21 岁以下”，从而保留随父母一起申请绿卡的机会。
